The Bombay High Court rejected to cancel a doctor's MBBS admission to a prestigious Mumbai college under the OBC-Non-Creamy Layer Certificate, citing misleading facts. The Bombay High Court made this ruling after observing that cancelation of admission might result in a loss for India, which has a low doctor-to-population ratio. However, the two-judge panel, comprising Justice AS Chandurkar and Justice Jitendra Jain, invalidated the student's OBC-Non-Creamy Layer Certificate and reclassified her admission to the open category.
The petitioner completed her MBBS education under interim court orders effective February 2014, following a multi-year litigation. However, the panel has now accepted that the petitioner utilized dishonest tactics to gain admission to the medical institution.
